Terms and Conditions Smorkyprint

1. General

These terms and conditions apply to all products, services, and offers from SmorkyPrint. By placing an order, the customer agrees to these terms and conditions. SmorkyPrint is located in the Netherlands and registered with the Chamber of Commerce.

2. Product Information

  • All products are described and displayed as accurately as possible.
  • Colors, dimensions, and textures may vary slightly due to screen settings or 3D print variations.
  • SmorkyPrint reserves the right to change product details without prior notice.

3. Orders and Payment

  • Orders will only be processed after receipt of payment.
  • Payment can be made via the payment methods offered on the website.
  • In case of incorrect pricing, SmorkyPrint reserves the right to cancel the order and notify the customer.
  • All stated prices include VAT, unless otherwise indicated.

4. Delivery

  • Products are printed to order; delivery time varies per model and is indicated with the product.
  • Delays due to technical malfunctions or material shortages do not entitle the customer to compensation.
  • Once the package has been shipped, the customer will receive a confirmation with tracking information.
  • SmorkyPrint delivers within the Netherlands and to selected EU countries. Delivery costs are clearly stated during the checkout process.

5. Right of Withdrawal, Returns, and Cancellation

  • Exclusion of right of withdrawal: Pursuant to Article 6:230p sub c of the Dutch Civil Code, there is no right of withdrawal for products that are custom-made or clearly personalized. All 3D prints from SmorkyPrint are manufactured specifically to order and therefore fall under this exception. The customer is explicitly informed of this before placing the order.
  • Cancellation is only possible before the printing process begins. Please contact us as soon as possible for this.
  • In case of defects or errors in delivery (demonstrably caused by SmorkyPrint), the customer must contact us within 14 days of receipt. In that case, SmorkyPrint will offer a replacement or a refund.
  • Consumers have a legal right to a product that conforms to the agreement. In case of defects, please contact us using the contact details at the bottom of this page.

6. Licenses and Intellectual Property

  • All STL and 3MF files are protected by copyright and may not be shared, copied, or resold.
  • SmorkyPrint exclusively sells prints with a valid license or its own design.
  • It is prohibited to commercially reproduce designs without written permission from SmorkyPrint.

7. Warnings and Safety

  • 3D prints are not toys unless otherwise stated.
  • Small parts can pose a choking hazard; keep out of reach of children under 3 years of age.
  • Avoid exposure to heat, moisture, and direct sunlight.
  • Use prints exclusively for decorative purposes, unless otherwise indicated.

8. Liability

  • SmorkyPrint is not liable for damage caused by incorrect use of products.
  • Technical errors or deviations in prints are not covered by warranty, unless demonstrably caused by SmorkyPrint.
  • Maximum liability is limited to the purchase price of the product concerned.
  • This limitation does not apply in cases of intent or gross negligence on the part of SmorkyPrint.

9. Privacy

  • Personal data will only be used for order processing and communication.
  • SmorkyPrint does not share customer data with third parties, except for shipping and payment, and acts in accordance with the GDPR (General Data Protection Regulation).

10. Applicable Law and Dispute Resolution

All agreements are governed by Dutch law. Disputes will be submitted exclusively to the competent court in the Netherlands. As a consumer, you can also use the European ODR platform for online dispute resolution: https://ec.europa.eu/consumers/odr.
